TERMS AND CONDITIONS

By completing our Booking Form you are agreeing to and have accepted the following terms and conditions of hire.

Terms :

‘You’ means you the client and your guests.
'Smile’ means us, Smile Photo Booths Limited, the service provider. We operate from 64 Mousehall Farm Road, Brierley Hill, West Midlands, DY5 2NJ.
'Booking Form’ refers to the online Booking Form contained on our web site or any signed and printed version of this form.
'Loading’ includes loading and unloading of all equipment.

Venue Access and Location
It is up to you to ensure Smile are provided with the correct address information for the venue and that the venue allows reasonable access for loading and suitable parking once the booth and equipment has been unloaded. If parking for loading is restricted you will be liable for any fines that occur as a result. If parking is charged for, you will be liable for all reasonable and unavoidable parking charges.

Events Beyond Our Control
Smile will make all reasonable endeavours to attend all events. Where circumstances make this impractical, such as, but not limited to, adverse weather, traffic delays or vehicle breakdown, Smile will contact you or the venue as early as possible and a full refund will be made. If the agreed ‘time of use’ for any event is not available then that part shall be refunded in full for that event unless it is due to the booth being withdrawn from service due to risk to the booth.

Set Up of Booth
It is up to you to ensure that the venue agrees to Smile being in attendance at the agreed time. 
Smile will be happy to liase with the venue to assist, if requested. Smile will require an electrical plug socket located within 6 feet of the booth.

Smile will arrive to setup approximately one hour before the hire period is due to commence. The hire period will be for a set period, typically 3 or 4 hours, but as specified in the Booking Form. Use will commence at the agreed time and finish at the agreed time. If for any reason we are not able to commence at the agreed time due to matters concerning us only, we will be happy to extend the end time of hire to make up for a late start. If we cannot start on time due to poor access or not being allowed access as required due to the venue or other such circumstances, we will keep to the agreed end period for the hire. If your event simply starts late or runs late, our period of hire will still be for the agreed period and times unless we agree to provide additional hours as per our additions or to simply delay our planned start.

Termination Of Hire
Smile will not tolerate any abuse or threatening behaviour to any of our staff or abuse of the booth or booth equipment. If this occurs Smile retain the right to terminate the hire immediately. This applies equally to you and your guests. Smile may terminate the hire in cases where our staff feel the equipment belonging to Smile or the booth itself is in danger of being damaged or has been damaged due to the actions or unruly behaviour of you or your guests.

Wherever possible and reasonable to do so we will speak with you or the venue first to try to resolve the matter before any termination is enacted. If we do terminate, for any reason, the full cost of hire will remain due and we will not issue any refunds for any period of hire not provided.

Moreover, you will be fully responsible for any damages caused by you or your guests or other attendees at the event to the booth or booth equipment howsoever caused, with the sole exclusion of Smile Staff.

Deposits Due
A deposit of at least £200 is required on booking and can be paid through our web site (once online payment is completed) or by cheque made payable to Smile Photo Booths and sent to Smile Photo Booths, 64 Mousehall Farm Road, Brierley Hill, West Midlands DY5 2NJ.

Cancellation
Up to 60 days before the event – Full refund of the booking fee less £150.
OR – Credit for full amount of the booking fee against a future event, less £50 administration fee.

Use Of Photos
Photos taken during the event may be used by us to assist with advertising and promotion of Smile. This may include printed matter as well as on line images. All images must be of a nature and form suitable for print.

Limited Liability
Smile Photo Booths will in all instances act in what it considers to be the best interests of the client and to take steps when required to act to protect the health and safety of booth users. Where such actions lead to an early closure of the booth, removal from service of the booth or other such action likely to cause distress or dissatisfaction Smile limits any refunds to the amount of the original booking less the booking deposit fee. This applies to all cases. It in no way affects general public liabilities or employers libility insurance matters which are covered separately.

Agreement To On Line Terms and Conditions
In the event of any conflict, these Terms And Conditions shall be taken as ‘those in place’ and be taken as those in place over any other wording on our web site. These may be changed by Smile without notice to you but Terms And Conditions must be in place for a minimum of 10 days prior to any event otherwise previous Terms And Conditions shall be deemed to apply to that event and therefore material to your agreement. Other terms or wording shall only be deemed to be agreed if so agreed in writing by Smile and you.

Cancellations

If a booking is cancelled by Smile any time up to 14 days prior to the booking date Smile will refund in full any deposit that has been paid in full. Cancellations are very rare but may occur if there is a double booking on a popular weekend or if there is some other reason why the booking cannot be fulfilled. In such circumstances we will endeavour to provide notice as early as possible. Bookings are normally accepted on a first come first served basis, subject only to geographical and logistical variances.

These terms and conditions will remain in place on the website and can be accessed by you at any time. The terms and conditions on the website at the time of your event shall be those considered to be valid for you. Additional Terms And Conditions may be added as seen fit by Smile. By completing our Booking Form you are agreeing to and have accepted these Terms And Conditions of hire.



IMPORTANT ADDITION TO TERMS

As of November 1st 2011 all bookings are considered to be in the ownership, control and the full responsibility of the present owners Adam and Charlotte Oakley. The previous owner(s) have sold assets of the business and are no longer involved in any form. All bookings made to date have been classed as part of the terms of sale and the new/present owners will honour and fulfill any existing bookings. All work will continue to be made and traded under the name of Smile Photo Booths Limited. The above named new owners will make all reasonable endeavours to provide a service for all booked events. The previous owners take no responsibility for any bookings made, taken, discussed and consider all to now be under the pervue of the new owners who shall take all reasonable action to fulfil their role. The previous owners shall not be held liable for any compensation for duress, stress, loss of business, or other issues caused by failure to provide a service at a future event. Smile under the new ownership will refund, in full, any and all payments made for any event it does not or cannot provide service to. Smile will continue to endeavour to give as much notice as possible whenever and if it cannot provide service at an event.
